> This agreement governs your membership and use of XFitness facilities and services.

Introduction
This site and all services offered herein are owned and operated by X FITNESS CENTRE (Business Registration No.: 202503023755, Old Registration No.: IP0604759-X) ("the Company").
While the official registered name is X FITNESS CENTRE, the brand is commonly referred to as XFitness across all signage, marketing materials, and social media platforms.
By signing up for a membership, purchasing an entry pass, or using any of our facilities or services in any capacity, you acknowledge and agree to be bound by the terms and conditions set forth below.
1. Membership Options & Terms
- Memberships are available in 1-month, 3-month, 6-month, and 12-month plans, with payment made via one-time full payment.
- By signing up, members agree to complete the full term of their selected membership.
- Failed Payments During Contract:
- If payment fails during an active contract, the member's access will be suspended until the outstanding amount is paid in full.
- Reactivation is only permitted after full payment of all dues.
- All memberships are non-transferable & non-refundable.
- By joining the club, members automatically accept and agree to be bound by these Terms and Conditions.
- Entry is only permitted to those with a valid and active membership, or a one-time entry pass.
- Memberships cannot be paused or extended without a formal freeze request (as outlined in Section 3).
2. Membership Rules & Conduct
- Members are expected to follow all gym rules, including proper conduct, hygiene, and equipment usage.
- Members must be 16 years or older. Those under 16 must be accompanied by a guardian.
- Individuals with contagious diseases are not allowed to become members, in the interest of protecting others' health and safety.
- Any form of misconduct, dangerous behaviour, or illegal activity may lead to immediate termination of membership without refund, at the sole discretion of the management.
- Damaging gym property, misuse of equipment, or disturbing other members will not be tolerated. Members are liable for any damage caused by malicious actions and must compensate for the losses. Legal action may be taken if necessary.
- Members must re-rack weights and return all equipment to its designated place after use.
- Proper gym attire and footwear must be worn at all times; sandals are not allowed.
- Members must adhere to all gym rules and regulations. In cases of inappropriate behaviour, staff may issue up to three warnings. Continued violations may result in immediate termination of membership.
- Members must not share their membership or key fob with others. Doing so may result in immediate termination of membership.
3. Membership Freeze
- Each membership is entitled to one (1) freeze request during its active period, subject to a one-time processing fee of RM150.
- The maximum freeze duration allowed depends on the membership type:
- 1-Month Membership: Not eligible to freeze
- 3-Month Membership: Up to 3 months freeze
- 6-Month Membership: Up to 6 months freeze
- 12-Month Membership: Up to 12 months freeze
- Freezing a membership will extend the contract duration accordingly.
- Members must notify gym management in advance to request a freeze.
- The RM150 processing fee is non-refundable and applies to both standard and extended freeze requests.
- During the freeze period, access to the gym is temporarily suspended.
4. Membership Fees & Payment
- All fees must be paid in advance.
- Accepted payment methods include debit/credit card, cash or QR payment.
- The Company reserves the right to revise membership fees with or without prior notice, in compliance with applicable laws.
5. Health & Safety Disclaimer
- The Company and its staff are not responsible for members' personal health conditions or injuries sustained on the premises.
- Use of all gym facilities is at your own risk.
- Personal belongings are the sole responsibility of the member. The Company is not liable for any loss, theft, or damage.
- Members are encouraged to obtain personal insurance for any potential loss, injury, or damage arising from gym use.
- Our staff, agents, and subcontractors are not medically qualified. If you have concerns about your health or fitness to exercise, please consult a doctor before beginning any workout. For safety, you are responsible for correctly using all facilities. If unsure about equipment usage, ask a staff member.
- Members should not use equipment or facilities while under the influence of drugs, alcohol, or medication that may impair their ability to exercise safely.
6. Access and Usage
- Members may only access the gym during official operating hours.
- All members are required to scan their key fob at the front desk to gain entry into the gym.
- Entry and usage of the gym are only permitted with a valid and active membership.
7. Key Fob Policy
- Each member will be issued one (1) key fob upon registration for gym access.
- All members are required to scan their key fob at the front desk to gain entry into the gym.
- Members who fail to present their key fob must provide relevant personal information (e.g. IC number) for staff to verify that their membership is active. Entry without verification will not be permitted.
- In the event of a lost or misplaced key fob, a replacement fee of RM30 will be charged.
- Faulty or defective key fobs may be replaced free of charge, subject to staff inspection and approval.
8. Termination Policy
The Company reserves the right to terminate any membership due to:
- Violation of gym rules
- Disrespectful or dangerous behaviour
Terminated members may be permanently banned from the facility.
In cases involving illegal activity or endangerment of others, the Company reserves the right to notify law enforcement authorities.
9. Refunds Policy
All fees paid are strictly non-refundable, including but not limited to early termination, voluntary cancellation, or dissatisfaction with services or facilities.
10. Entire Agreement
This agreement supersedes all prior written or verbal agreements, terms, or policies between the Company and the member.
11. Data Protection (PDPA)
By registering, you consent to the collection, use, and processing of your personal data in accordance with Malaysia's Personal Data Protection Act (PDPA) 2010.

12. Final Interpretation Clause
This Terms & Conditions document was written and issued on 6 July 2025. The Company reserves the right to amend these Terms & Conditions at any time. Updated versions will be made available at the front desk and on our website.
13. Online Services & Digital Terms
In addition to the above terms, the following apply to our online services, website, and mobile application:
Website & Mobile App Usage
- You agree to use our website and mobile application only for lawful purposes and in accordance with these Terms.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately of any unauthorized access to your account.
Online Payments
- All online payments are processed securely through our payment gateway partner (Revenue Monster).
- Payment transactions are subject to the terms and conditions of the payment processor.
- We reserve the right to refuse or cancel any payment transaction at our sole discretion.
Class Bookings & Cancellations
- Class bookings made through our website or mobile app are subject to availability.
- Cancellation policies apply as per the class booking terms displayed at the time of booking.
- Late cancellations or no-shows may result in penalties or loss of booking privileges.
Digital Content & Intellectual Property
- All content on our website and mobile app, including text, graphics, logos, and software, is the property of XFitness and protected by copyright laws.
- You may not reproduce, distribute, or create derivative works from our digital content without prior written permission.
Service Availability
- We do not guarantee that our website or mobile app will be available at all times or free from errors.
- We reserve the right to modify, suspend, or discontinue any part of our online services at any time.
