> These Terms and Conditions ("Legal Terms") constitute a legally binding agreement between you ("Member," "User," or "you") and X Fitness Centre (Business Registration No.: 2025003023755, Old Registration No.: IP0604759-X), including our brand X Fitness ("Company," "we," "us," or "our").

1. Contractual Relationship

These Terms and Conditions ("Legal Terms") constitute a legally binding agreement between you ("Member," "User," or "you") and X Fitness Centre (Business Registration No.: 2025003023755, Old Registration No.: IP0604759-X), including our brand X Fitness ("Company," "we," "us," or "our").

These terms govern your access to and use of our:

  • Physical Facilities: Our fitness centres, gym premises, and all equipment.
  • Mobile Application: The X Fitness App.
  • Website: https://www.xfitness.my.
  • Related Products: Any personal training, fitness programs, or content provided by us.

Collectively, these are defined as the "Services." By accessing any of these Services, you agree to be bound by these Legal Terms. If you do not agree, you must immediately cease all use of our Services.

2. Eligibility & Minors

To create an account, you must be at least 18 years of age (the age of majority in Malaysia). Individuals aged 16 and 17 may access the Services only with the express consent of a parent or legal guardian. Users under 16 must be accompanied by a guardian at all times within our physical premises.

3. Description of Services

The X Fitness App provides a platform for personal training bookings, membership management, and fitness content. Access to our physical facility is managed via the App using QR codes or facial recognition technology.

4. Facility Access & Security Protocols

  • Biometric Entry: Entry is granted via facial recognition or App-generated QR codes. By using these features, you consent to the collection of biometric data for security and access control.
  • No Access Sharing: Your membership is personal to you. Sharing your App login, QR code, or key fob with a third party is a material breach of this contract and may result in immediate termination without a refund.
  • Surveillance: For the safety of our community, our premises are under 24-hour CCTV surveillance.

5. Gym Rules & Code of Conduct

Members agree to maintain a safe and respectful environment. The following rules are strictly enforced:

  • Equipment Care: Members must handle all gym property with care. Do not slam dumbbells or bumper plates heavily on the floor. Equipment must be controlled throughout the entire range of motion and lowered to the floor in a controlled manner to prevent damage to the equipment and flooring.
  • Hygiene & Etiquette: Members must wipe down equipment after use, re-rack all weights, and return accessories to their designated storage.
  • Prohibited Behavior: Misconduct, dangerous behavior, illegal activity, or disturbing other members will not be tolerated.
  • Dress Code: Standard athletic attire and closed-toe sports shoes are required. Sandals, flip-flops, or bare feet are strictly prohibited.
  • Health Status: Members with contagious illnesses are prohibited from using the facility to prevent public health risks.
  • Damage to Property: You are financially liable for any damage to equipment or the facility caused by negligence or malicious misuse.
  • Disciplinary Policy: Staff may issue up to three (3) warnings for minor violations. Serious misconduct (theft, harassment, etc.) or a third warning will lead to immediate termination.

6. Subscription Commitment & Automatic Renewal

  • Minimum Commitment Term: Certain membership plans are subject to a Fixed Minimum Commitment Term (e.g., 12 months). You agree to remain a member and pay the monthly fee for the entire duration of this term.
  • Continuous Billing (Evergreen Clause): Upon the expiry of your Minimum Commitment Term, your membership will not automatically terminate. It will automatically convert to a month-to-month rolling subscription. Billing will continue on a monthly basis at the prevailing rate until you formally cancel your membership by visiting our branch in person.
  • Price Adjustments: We reserve the right to revise fees with at least seven (7) days' notice. Price changes will not affect an active Minimum Commitment Term but will apply once the term converts to month-to-month.

7. Cancellation Policy

  • Mandatory In-Person Cancellation: All cancellations must be done in person by visiting our branch.
  • During Minimum Term: You may submit a request at any time; however, the cancellation will only take effect upon the completion of your Minimum Commitment Term. You are responsible for all payments until the term expires.
  • Month-to-Month Cancellation: Once the Minimum Commitment Term has passed, you may cancel by visiting our branch.
  • Effectivity: To avoid being charged for the next month, cancellation must be submitted before your next billing cycle. If you cancel mid-cycle, the cancellation takes effect at the end of the current paid period.
  • Early Release: Termination of a commitment term is only permitted for permanent medical disability (verified by a medical certificate).

8. Refund Policy

  • Final Sale: In general, all payments are non-refundable.
  • Consumer Protection: Pursuant to the Consumer Protection Act 1999, refunds may be considered for verified medical disability (supported by a medical certificate).
  • Termination for Breach: If your membership is terminated due to a violation of the Gym Rules, you remain liable for any unpaid balance of your Minimum Commitment Term.

9. Health Disclaimer & Assumption of Risk

  • You warrant that you are in good physical health and have no undisclosed medical conditions.
  • You voluntarily assume all risks of injury, illness, or death associated with exercise.
  • We are not a medical organization; fitness guidance provided is for educational purposes only and not a substitute for professional medical advice.

10. Limitation of Liability

To the maximum extent permitted by Malaysian law:

  • We are not liable for any indirect or consequential losses.
  • Statutory Liability: We do not exclude liability for death or personal injury resulting directly from our proven negligence, as mandated by the Consumer Protection Act 1999.
  • Personal Property: We are not responsible for the loss, theft, or damage of personal items brought into the facility.

11. Intellectual Property

All content on the App and Website (logos, code, videos, graphics) is the property of X Fitness. You are granted a limited, personal license for individual use only.

12. Privacy & Data Protection

Your data is handled in accordance with the Personal Data Protection Act (PDPA) 2010.

  • Biometrics: You expressly consent to our processing of your facial data for entry and security.
  • Hosting: You acknowledge that your data may be hosted on secure servers in Singapore.

13. Term & Termination

This agreement remains in force while you have an active account. We reserve the right to suspend or terminate access for suspected fraudulent activity or breach of these Legal Terms.

14. Governing Law

These Terms shall be governed by the laws of Malaysia. Any disputes shall be submitted to the exclusive jurisdiction of the Malaysian courts.
